Congratulations to Speak Up Titusville, a citizens’ group who prevailed in a court ruling today!
Last year, Speak Up Titusville sponsored an initiative to amend their city charter for a local right to clean water and worked incredibly hard to collect enough petition signatures to be qualified for the ’22 ballot. The City sued, the voters of Titusville overwhelmingly approved the amendment, but the City refused to codify it.
Today, the trial court ruled against the City and for Speak Up Titusville, that the amendment was sufficient in ballot title and summary, that it survived the statutory preemption, and that the City had a duty to codify it.
TBD whether the City appeals this decision, but today, let’s give a big
congratulations to this small group of citizens who simply want clean water. They didn’t do anything wrong, yet face a *hefty* bill for attorney fees.
